Terms of Service

These Terms of Service ("Terms") govern your access to and use of the FieldFirst Safety platform, including the website at fieldfirstsafety.ca and all associated applications (collectively, the "Service"), operated by FieldFirst Safety Inc. ("FieldFirst Safety", "we", "our", or "us").
By creating an account or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
1. Description of Service
FieldFirst Safety is a collaborative workplace safety platform that enables crews and supervisors to create, complete, and manage Field Level Hazard Assessments (FLHAs) in real time. The Service includes tools for hazard identification, control documentation, crew sign-offs, compliance tracking, and safety procedure management.
The Service is intended for use by employers, supervisors, and workers operating in industries where field-level hazard assessment is a standard safety practice, including but not limited to construction, oil and gas, utilities, and industrial operations.
2. Accounts and Access
Account creation
You must create an account to use the Service. You may sign in using a supported third-party identity provider (Microsoft or Google). You are responsible for maintaining the confidentiality of your account and for all activity that occurs under your account.
Eligibility
You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this requirement.
Organization accounts
When you sign in with a work email address, your account is automatically associated with your organization. Organization administrators have the ability to manage member roles, invite team members, view all FLHAs, and configure company-wide settings. You acknowledge that your organization may have access to data you create within the Service.
Account termination by organization
If your organization removes you from the Service, your access will be revoked. Content you created as part of your organization's account may remain accessible to your organization.
3. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of applicable regulations
- Submit false, misleading, or fraudulent FLHA data
- Impersonate another person or organization
- Attempt to gain unauthorized access to other users' accounts or data
- Use the Service to store or transmit malicious code
- Interfere with or disrupt the integrity or performance of the Service
- Reverse engineer, decompile, or disassemble any part of the Service
- Resell or sublicense access to the Service without our written consent
We reserve the right to suspend or terminate accounts that violate these restrictions.
4. Important Safety Disclaimer
FieldFirst Safety is a documentation and collaboration tool. It is not a substitute for proper safety training, qualified supervision, regulatory compliance programs, or professional safety consulting.
FLHAs completed using our Service are the sole responsibility of the individuals and organizations completing them. FieldFirst Safety does not review, validate, or certify the content of any FLHA, and makes no representations regarding whether completed FLHAs satisfy applicable workplace safety legislation or regulations.
You are responsible for ensuring that your use of the Service complies with all applicable occupational health and safety laws, regulations, and standards in your jurisdiction.
5. Subscriptions and Payment
Plans
The Service is offered on a subscription basis with multiple plan tiers (Free, Starter, Growth, Pro, and Enterprise). Plan details, pricing, and seat limits are described on our pricing page. We reserve the right to modify pricing with reasonable advance notice.
Billing
Paid subscriptions are billed in advance on a monthly or annual basis. Payment is processed through Stripe. By providing payment information, you authorize us (via Stripe) to charge the applicable fees to your payment method.
Annual billing
Annual subscriptions are billed once per year at a discounted rate equivalent to 10 months of the monthly price. Annual subscriptions are non-refundable except as required by applicable law.
Seat limits
Each plan includes a maximum number of team members (seats). Exceeding the seat limit for your plan requires an upgrade to a higher tier. We will notify administrators when your organization approaches the seat limit.
Cancellation
You may cancel your subscription at any time through the billing portal. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the end of the period you have paid for.
Refunds
Monthly subscriptions are non-refundable for the current billing period. Requests for refund exceptions may be submitted to [email protected] and will be considered on a case-by-case basis.
6. Intellectual Property
Our intellectual property
The Service, including its design, software, trademarks, and all content we create, is owned by FieldFirst Safety Inc. and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, trade names, or logos.
Your content
You retain ownership of all content you submit to the Service, including FLHA data, company procedures, and other materials ("Your Content"). By submitting Your Content, you grant us a limited, non-exclusive, royalty-free licence to store, process, and display Your Content solely as necessary to provide the Service to you.
You represent that you have all rights necessary to grant this licence and that Your Content does not violate the rights of any third party.
7. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
8. Availability and Service Level
We aim to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform maintenance, updates, or experience outages beyond our control. We are not liable for any losses arising from Service unavailability.
Enterprise plan subscribers may negotiate a Service Level Agreement (SLA) separately in writing.
9. Limitation of Liability
To the fullest extent permitted by applicable law, FieldFirst Safety Inc. and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.
Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or CAD $100, whichever is greater.
10. Indemnification
You agree to indemnify and hold harmless FieldFirst Safety Inc. and its affiliates, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, Your Content, or your violation of these Terms.
11. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms, non-payment, or if we determine in our discretion that such action is appropriate. You may terminate your account at any time by contacting us or using the account deletion feature.
Upon termination, your right to access the Service ends. Provisions of these Terms that by their nature should survive termination (including sections on intellectual property, limitation of liability, and indemnification) will survive.
12. Governing Law
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Alberta, Canada, and you consent to exclusive jurisdiction and venue in those courts.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a new effective date. If you continue to use the Service after updated Terms are posted, you accept the revised Terms.
